THE CHARTER TOWNSHIP OF WATERTOWN NO. 2
DUMP ORDINANCE
An ordinance to regulate the disposing of rubbish, in the Charter Township of Watertown, Clinton County, Michigan. The Township Board of the Charter Township of Watertown ordains:
Section I
For the purpose of this Ordinance, the following words shall have the meaning given herein:
(1) “Ashes” – residue from the burning of wood, coal, coke, or other combustible material.
(2) “Garage” – is putrescible animal or vegetable waste, resulting from the handling, preparation, cooking and consumption of food.
(3) “Person” – is any person, firm, partnership, association, corporation, or organization of any kind.
(4) “Rubbish” – is non-putrescible solid waste (excluding ashes) consisting of both combustible and non-combustible waste, such as paper, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery, and similar materials.
(5) “Commercial rubbish collectors” – persons collecting rubbish for hire, from one or more persons or householders.
Section II
The Township Board shall have the general supervision of the Township Dump and shall, from time to time, make such rules and regulations promulgated by the Township Board, and shall be kept on file with the Township Clerk.
Section III
From and after the effective date of this Ordinance, no person shall throw or deposit any ashes, garbage, or rubbish on any road, highway, public place, stream, or other body of water in the Charter Township of Watertown.
All ashes and rubbish shall be deposited in the Township Dump.
Section IV
No person, or persons, except those residing in the Charter Township of Watertown, shall have the right to use said Dump of the Charter Township of Watertown. NO commercial rubbish collector shall have the right to use said Dump.
Section V
No person, or persons, shall dump any garbage in the Township Dump and no person, or persons, shall do any burning or set fire to any accumulations of rubbish in said Dump, except that they first obtain a permit for such burning from the fire chief of the Charter Township of Watertown.
Section VI
The Township Dump shall be used and open only between 8:00 a.m. and 5:00 p.m., on every Saturday, and no use shall be made of the Township Dump on any other day or days.
Section VII
There shall be no dumping except in the areas designated by the attendant on duty
Section VIII
There shall be a charge levied for the use of the Township Dump, said charge to be as follows:
(1) $.50 for car.
(2) $1.00 for pick-up truck and/or trailers.
(3) $2.00 for any truck larger than that known as pick-up trucks.
Section IX
Any person violating any of the provisions of this Ordinance, shall be guilty of a misdemeanor and upon conviction thereof, shall be fined not more than One Hundred and 00/100 ($100.00) Dollars, or imprisonment in the County Jail not to exceed Ninety (90) days or by both such fine and imprisonment.
Section X
Severability Clause- if any of the provisions of this Ordinance shall contravene or be invalid under any laws of the State of Michigan, County or Clinton, or jurisdiction where used, such contravention or invalidity shall not invalidate the whole agreement, but it shall be construed as if not containing the particular provision or provisions held to be invalid and the rights and obligations.
Section XI
Publication of this Ordinance shall be made by causing a true copy thereof to be inserted once in some newspaper circulated within said Township which insertion shall be made within ten (10) days after the passage thereof. This ordinance shall not take effect until thirty (30) days have elapsed after the first publication of the Ordinance.
