ORDINANCE NO. 17

 

            An ordinance to designate an enforcing agency to discharge the responsibilities of the Charter Township of Watertown under the provisions of the State Construction Code Act (Act 230 of the Public Acts of 1972, as amended) and to adopt a Building Code upon which enforcement of the Ordinance shall be based.

 

THE CHARTER TOWNSHIP OF WATERTOWN ORDAINS:

 

Section 1.         Agency Designation.     Pursuant to the provisions of the Michigan Building Code, in accordance with Act 230 of the Public Acts of 1972, as amended, the Building Inspector of the Charter Township of Watertown is hereby designated as the enforcing agency to discharge the responsibilities of the Charter Township of Watertown under Act 230 of the Public Acts of 1972, as amended, State of Michigan.  The Charter Township of Watertown assumes responsibility for the administration and enforcement of said Act throughout its corporate limits.

 

Qualifications for Building Inspector: The building inspector shall be generally informed on the principles and practices of good building construction, fire prevention, the proper installation of plumbing, heating and electrical systems, and shall be capable of reading and interpreting plans and specifications.

1.      Duties and Powers:

a.      The building inspector shall be responsible to the Township Supervisor for the enforcement of the provisions of the building regulations of the Township and shall perform such other duties as the Supervisor may direct him to perform.

b.      It shall be the duty of the building inspector to receive all applications for building permits, issue permits, collect fees therefore, inspect all buildings for which permits have been issued, investigate all complaints concerning violations of this chapter, make every effort to detect violations of this chapter and to take all necessary steps to abate such violations.

2.      Relief from liability in performance of duties: The building inspector shall be relieved of all personal responsibility from and in all suits for any alleged or sustained damage or damages to property or persons arising from the performance of his duty where he is acting in good faith and without malice to enforce the provisions of the chapter.

3.      Right of entry: In the discharge of his duties, the building inspector and his assistants shall be given the right to enter any building or premises at all reasonable hours to enforce to provisions of this chapter or to investigate any suspected or alleged violations.

 

Section 2.         Building Code Adoption.          That a certain document, a copy of which is on file with the Township Clerk at the Watertown Charter Township hall, being marked and designated as “The BOCA Basic/National Building Code, Tenth Edition, 1987” as published by the Building Officials and Code Administrators International, Inc., be and hereby is adopted as the Building Code of the Charter Township of Watertown in the State of Michigan; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA Basic/National Building Code, are hereby referred to, adopted and made a part hereof as if fully set out in this Ordinance.

 

Section 3.         Building Code Adoption.  The Construction board of Appeals shall consist of three (3) members to be appointed by the Township Board of Trustees.  The initial length of appointments shall be for one (1), two (2) and three (3) year terms.  Thereafter, the term of each appointment shall be for three (3) years.  Compensation of members shall be on a per diem basis and determined by the Board of Trustees.  Procedural requirements for the Construction Board of Appeals are outlined under Act 230 of the Public Acts of 1972.

 

Section 4.         Fees.    A schedule of fees shall be established by resolution of the Board of Trustees of the Charter Township of Watertown, and revised as necessary in order to defray the cost of administering and enforcing the provisions of this ordinance.  A current fee schedule shall be maintained by the Township Clerk.

 

Section 5.         Severability.      Should any section or part thereof of this Ordinance be declared unconstitutional, null or void by a court of competent jurisdiction, such declarations shall not effect the validity of the remaining sections or parts thereof of this Ordinance.

 

Section 6.         Effective Date.  The Township Clerk shall certify to adoption of this Ordinance and cause the same to be published as required by law.  This Ordinance shall take full force and effect thirty (30) days after this date of final passage and approval.

ORDINANCE 17.1

BUILDING ORDINANCE

 

An ordinance to amend Ordinance No. 17 of the Charter Township of Watertown known as the Watertown Charter Township Building Ordinance, to establish minimum regulations governing the design, construction, alteration, enlargement, repair, demolition, removal, maintenance and use of all buildings and structures; providing for the issuance of permits, collection of fees, making of inspections; providing penalties for the violation thereof; known as the building code; and repealing existing Ordinance number 17, section 2, of the Charter Township of Watertown, State of Michigan.

 

Be it ordained by the Board of Trustees of the Charter Township of Watertown as follows:

 

SECTION 1.   ADOPTION OF BUILDING CODE.

            That a certain document, one copy of which is on file in the office of the Clerk of the Charter Township of Watertown being marked and designated as “The BOCA National Building Code, Twelfth Edition, 1993” as published by The Building Officials and Code Administrators International, Inc. be and is hereby adopted as the Building Code of the Charter Township of Watertown in the State of Michigan; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Building Code, are hereby referred to, adopted and made a part hereof as if fully set out in this Ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section 3 of this Ordinance.

 

SECTION 2.   INCONSISTENT ORDINANCES REPEALED.

            That Ordinance Number 17 of the Charter Township of Watertown entitled Building Inspector Ordinance, Section 2, Building Code Adoption, and all other ordinances or parts of ordinance in conflict herewith are hereby repealed.

 

SECTION 3.   ADDITIONS, INSERTIONS AND CHANGES.

            Section 101.1 Insert:  Watertown Charter Township

 

Section 112.3.1.Insert:  Fee Schedule: The schedule of fees as adopted by resolution of the Watertown Charter Township Board of Trustees on April 17, 1989.

 

            Section 3408.2 Insert:  May 17, 1989.

 

SECTION 4.   SAVINGS CLAUSE.

            That nothing in this Ordinance or in the building code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any causes or action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this Ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

 

SECTION 5.   DATE OF EFFECT

            That the Township Clerk shall certify to the adoption of this Ordinance and cause the same to be published as required by law; and this Ordinance shall take full force and effect upon publication of the adopted Ordinance.

 

The second reading and vote to adopt Ordinance 17.1 will take place at the regular meeting on Monday, October 18, 1993.
